Terms of Sales
1. General
These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all the services offered by "Julie BERNARD", a sole proprietorship referred to below as "Les Fées Mains" registered by Julie BERNARD under the SIRET number 84002837700017, and this, to all of its customers, regardless of their status or quality. Consequently, the placing of an order by a customer for the performance of a service offered either at the massage room located at the address 455 Chemin de la Roche, 07150 Salavas, or at the hotel le Belvédère, route des gorges de l'Ardèche 07150 Vallon pont d'arc, either at the Rives d'arc campsite, route des gorges de l'Ardèche, 07150 Vallon pont d'arc or by telephone on 06.59.72.22.58, or on the website www.lesfeesmainsmassage.com entails the adhesion of the latter and their acceptance, without reservation, of these GCS except by special agreement previously agreed in writing between the parties. The sale will only be completed after the express acceptance by any written means of the order by "Les Fées Mains ".
“Les Fées Mains” reserves the right to modify these T&Cs at any time, it being specified that the modifications will only apply to orders placed following the entry into force of the said modifications.
Any document other than these T&Cs, in particular advertisements, prospectuses, flyers, etc., is only informative of the activity offered by "Les Fées Mains" and is non-contractual.
2- Definitions:
The services offered are those listed on the “Les Fées Mains” website and in the massage room, namely:
Well-Being & Detox Massage services at the session or as a cure.
Gift cards for these same Well-Being & Detox Massage services
Booking for these Well-Being & Detox Massage services
The Client is the person who books a Wellness & Detox Massage session or who buys a gift card at “Les Fées Mains”.
The Beneficiary is the person who receives a “Les Fées Mains” gift card.
3- Conditions of performance of the services:
The purpose of the activity of "Les Fées Mains" carried out by Julie BERNARD is exclusively the well-being of the person. In accordance with the legislation in force, the Well-Being & Detox Massages practiced by Julie BERNARD in the absence of diagnosis and therapeutic treatment, are in no way similar, neither in content nor in objective, to the practice of Masso-Kinesitherapy, as well as any medical practice. These are manual techniques for well-being and relaxation only. Are also excluded from the activity of “Les Fées Mains”, all services of an erotic or sexual nature. At a minimum, wearing a disposable thong is mandatory, no naked massage will be performed. Any inappropriate behavior towards Julie BERNARD may be the subject of legal proceedings.
"Les Fées Mains" can only be performed by appointment at the fully equipped massage room located at the Cabinet (455 chemin de la roche 07150 Salavas), at the hotel Le Belvédère (route des gorges de l'Ardèche, 07150 Vallon pont d'arc) or at the Les Rives d'Arc campsite (Route des gorges de l'Ardèche, 07150 Vallon pont d'arc).
She can exceptionally travel within a radius of 20 km from the massage room to the client's home, in a professional environment, in a school or leisure environment, in health establishments (hospitals, clinics, retirement homes, etc.), or in all places open to the public (events, exhibitions, congresses, etc.) for a minimum of 3 hours of presence or upon acceptance of an estimate by the client. In this case, the customer agrees to make available to "Les Fées Mains" a space (minimum 5 m2 in the event of a seated massage intervention and 10 m2 in other cases) whose conditions of hygiene, calm and safety are compatible with performing a massage.
The services are offered from Monday to Saturday according to the times indicated on the 'contact' page of the website www.lesfeesmainsmassage.com. Julie BERNARD gives herself the right to modify the schedules at any time.
During Well-Being & Detox Massage sessions, "Les Fées Mains" provides the client with all the necessary professional equipment (massage table or chair, protective linen, towels, massage oils, accompanying music, products hygienic,…) and reserves the right to refuse a Wellness Massage session in the event of questionable hygiene on the part of the client.
The session begins with a short questionnaire which will allow us to take stock of the client's condition and needs in order to determine the most suitable massage. A time will be left to the customer so that he can settle down. Body wipes will be made available for the client to freshen up if necessary before the massage. A disposable thong (male or female) will be offered in order to take full advantage of all the maneuvers carried out. The customer can choose to keep his underwear (no underpants or boxers for men) or swimsuit (no shorts but the oil may stain them...
After checking that the client is properly installed, the massage can begin. The comfort and modesty of the customer will be ensured by a set of sheets and towels.
At the end of the massage, time will be left for the client to come to his senses and get dressed. A point will be made on the mutual feeling and some advice will be given.
Sessions include pick-up, set-up, massage and end debrief.
4- Contraindications to Wellness Massages
When practiced by a qualified professional, Well-Being Massage is generally risk-free and rather beneficial. However, in case of illness or doubt, it is recommended that the client seek medical advice. Indeed, there are total, local or temporary contraindications to detox massage. Some treatments require precautions to be taken by “Les Fées Mains”.
In any case, areas with varicose veins, burns, open wounds or any signs of inflammation or local infection will not be massaged.
Contraindications to massage:
– Feverish, infectious or contagious state
– Hemophilia
– Phlebitis: Formation of a blood clot in a vein. Symptoms: pain, heaviness, swelling of a limb.
– Severe high blood pressure if not treated effectively
– Acute pain, inflammation or injury
– Surgical operation less than 3 months old
– Pregnancy less than 3 months
A few precautions:
– Pregnancy for more than 3 months: It is best to seek medical advice if you have concerns during pregnancy.
– Cancer, heart problems, any systemic, chronic or autoimmune disease: A written medical opinion specifying the precautions to be taken is mandatory
– Allergy, anti-coagulant treatment and breastfeeding: Prevent “Les Fées Mains”
To ensure that his client is fit to receive a well-being massage, a questionnaire will be completed during the first session. The client declares to inform “Les Fées Mains” beforehand of any changes in his state of health during the next appointments.
Consequently, "Les Fées Mains" reserves the right to refuse at any time, a client whose state of health is not compatible with the realization of a Well-Being Massage on his person without prior medical advice.
5- Financial conditions
The prices of the services offered are indicated in euros on the site https://www.lesfeesmainsmassage.com/ and at the office located at 455 chemin de la roche 07150 salavas.
"Les Fées Mains" is not subject to Value Added Tax (VAT) in accordance with article 293B of the General Tax Code, the prices mentioned on the website and at the massage room are therefore indicated without VAT. . In the event that "Les Fées Mains" would become subject to VAT, the prices displayed on the site will be readjusted accordingly and applicable to any order placed following the date of its submission.
“Les Fées Mains” also reserves the right to modify its prices at any time, it being specified that the services will be invoiced on the basis of the prices in force at the time of booking the appointment.
6- Making an appointment for Well-Being Massages at the session, modifying or canceling a reservation
6-1- Making an appointment:
It is done by email or telephone. All the contact details needed to make an appointment are available on the website https://www.lesfeesmainsmassage.com/ .“Les Fées Mains” reserves the right to contact the customer to change the time of the appointment or the postponement .
In order to allow a midday break to regain strength, online booking is closed between 12:30 p.m. and 2:30 p.m. (except Saturdays). Reservations during this time slot will only be made by telephone.
6-2- The conditions for modifying and canceling a session:
The customer has the possibility of modifying his reservation free of charge up to 24 hours before the appointment by telephone . If the 24 hour deadline is exceeded, the session will be considered due.
The customer has the possibility of canceling his reservation up to 24 hours before the appointment either by telephone or by email at the following address lesfeesm1@gmail.com. The customer has the possibility to cancel his reservation 24h before the appointment by telephone, if this is not the case a deduction of 30% of the total price will be applied (unless there is proof). An invoice will be issued for any reservation by telephone. This clause is also valid if the client does not show up on the day of the session.
6-3- Payment:
For reservations by telephone, payment is made at the meeting place either by cash, check at the end of the session.
6-4- Management of delays:
Appointments are made by “Les Fées Mains” so that there are no delays. A time is planned between each massage which makes it possible to welcome the next client in the best possible conditions.
The customer is asked to arrive at the time indicated when making the appointment. If the client arrives early, the massage room may not be ready yet, if the client arrives late, the session may be shortened; “Les Fées Mains” cannot afford to keep the following meetings waiting…
7- the purchase of a package or cure, the reservation, the modification or the cancellation of a reservation
7-1- The purchase of a cure:
The cures are to be paid in 1, 2 or 3 payments from the first session either in cash, by check. They are valid for 1 year from the date of purchase.
The cures are nominative, non-transferable and do not give rise to any refund or extension of the period of validity, except in the event that I cannot provide the service or medical reason (on proof).
A nominative form specifying the nature of the service will be given when purchasing the treatment, which "Les Fées Mains" will tick off at the start of each session.

8- The purchase of gift cards and the reservation, modification or cancellation of the reservation by the beneficiary
8-1- The purchase of gift cards
The purchase of gift cards is only made on site in direct sale and by appointment. The customer has the choice among all the formulas present on the treatment menu. A unique and nominative gift card in cardboard format in a white envelope will be given to the customer. Payment will be made in cash or by check.
8-2- Terms of gift cards:
All gift cards are numbered, personal and non-transferable. The expiry date is indicated on the gift card:
Unless otherwise stated, gift cards are valid for 1 year from the date of purchase. They do not give rise to any refund or extension of the period of validity, except in the event that I cannot provide the service or for medical reasons (on proof). Gift cards will not be replaced or refunded if lost or stolen.
8-3- Reservation, modification or cancellation of a gift card reservation:
Reservations are made by phone or email.
The customer does not have the possibility of modifying or canceling his reservation within 24 hours before the appointment (unless there is proof). The service will be considered due and the gift card will be lost. This clause is also valid if the client does not show up on the day of the session.
8-4- Management of delays:
Appointment booking by « The Fairies Hands is carried out in such a way that there is no delay. A time is planned between each massage which makes it possible to welcome the next client in the best possible conditions.
The customer is asked to arrive at the time indicated when making the appointment. If the client arrives early, the massage room may not be ready yet, if the client arrives late, the session may be shortened; “Les Fées Mains” cannot afford to keep the following meetings waiting…
9- Preferential rates:
Discounts granted under advertising or an agreement with a works council, sports club, etc. apply to the normal rate and not to the current promotional rate. They are valid according to the conditions of the offers put in place.
The preferential rates for Works Councils and partner Associations will only be applied on presentation of the card of your Works Council or Association.
10- Services requiring a personalized quote (events, fairs, congresses, etc.)
The quote is valid for one month from the date of issue thereof.
The estimate and the GCS signed by the customer are valid for agreement and purchase order. The quote and the signed T&Cs must be accompanied by a payment of 30% of the total amount indicated on the quote. The payment of this deposit will be made by check or bank transfer.
Except for an additional payment period agreed by agreement between the two parties and appearing on the invoice, the balance of the payment is made in cash within a maximum period of 15 (fifteen) days following the date of issue of the invoice, by check or bank transfer. In the event of late payment, a penalty fixed at 15% of the amount of the invoice, per month of late payment, is payable without a reminder being necessary, from the day following the payment deadline.
Any request for postponement or cancellation by the customer must be sent to "Les Fées Mains » at least 15 (fifteen) working days before the scheduled date. Failing this, “Les Fées Mains” will be entitled to invoice, as compensation, 50 (fifty) percent of the total amount of the invoice, before deduction of the deposit received.
If the cancellation occurs within 7 (seven) working days before the fixed date, "Les Fées Mains" will be entitled to invoice, as compensation, 75 (seventy-five) percent of the total amount of the invoice, before deduction of the deposit received.
In the event of cancellation on the spot or the day before, the indemnity will be 100 (one hundred) percent of the amount of the service provided.
In the event of cancellation at the initiative of “Les Fées Mains” and if no replacement date is agreed, the latter will reimburse the customer for the deposit received within a maximum period of 8 (eight) days.
11- Incapacity for work
In the event of temporary physical incapacity, following illness or accident of Julie BERNARD "Les Fées Mains " reserves the right to reschedule new dates of interventions in consultation with the client without the latter being able to demand payment of compensation. In the event of the practitioner's permanent physical incapacity, any type of contract or commitment with the customers of "Les Fées Mains" will be automatically terminated without it being possible to claim compensation from "Les Fées Mains". The deposits received will be returned to the customer within a maximum period of 8 ( eight) days following termination of the contract.[/vc_column_text]
12- Applicable law and competent jurisdiction
These T&Cs are subject to French law. In the event of a dispute, the parties undertake to seek an amicable solution before any legal action. Failing this, any dispute arising with a customer having the status of merchant and which would be linked to the interpretation, execution or validity of these GCS will be subject to the exclusive jurisdiction of the courts of Lille. For all other customers, the provisions of the Code of Civil Procedure will apply.
13- Intellectual property
Julie BERNARD is the holder of the intellectual property rights on all the elements present visible on the site https://www.lesfeesmainsmassage.com/ , in particular: texts, images, photos, graphics, logo. Julie BERNARD also holds the intellectual property rights of the “Les Fées Mains” brand.
Any reproduction, representation, modification, publication, adaptation or exploitation of all or part of the brand "Les Fées Mains" or other elements of the site https://www.lesfeesmainsmassage.com/ is prohibited on any medium whatsoever and in any way. any way except with written agreement from Julie BERNARD.

15- Professional Civil Liability (RCP)
Julie BERNARD has taken out professional civil liability and operating risk insurance with a notorious company.
It is specified that Julie BERNARD cannot be held liable in the event of damage linked to the negligence of a client, in particular if he has not revealed to Julie BERNARD the existence of contraindications affecting him, whether during the interview for the first session to alert him to the applicable contraindications, or subsequent appointments in the event of changes in his personal state of health – See all contraindications in point 4.
